USING FIDIC CONTRACTS TO MANAGE RISK IN OIL & GAS PROJECTS

The current worldwide Covid 19 pandemic has brought into sharp focus the need for project teams to be vigilant and pro-active in their approach to risk. A large part of the focus has to be the selection of the correct contract with which to carry out the project and to ensure that it is primarily used as a Risk Management tool as part of the wider toolkit of Risk Management techniques.

This is particularly important in large scale international projects involving parties from different countries and legal systems, a scenario frequently found in Oil and Gas contracts. The FIDIC family of contracts has been developed specifically to cater for this type of contractual situation and is focussed on managing rather than penalties.

The course focus is developing an effective risk strategy and effectively using different approaches to risk allocation through knowledge, understanding and use of different FIDIC forms and their uses within Oil and Gas Projects. There is a practical project and business risk emphasis.

EPC CONTRACTS FOR OIL & GAS PROJECTS
EPC or Engineering, Procurement and Construction contracts – also known as “Turnkey” contracts because of the fact that the client has little to do apart from “turning the key” at the end of commissioning – are a common form of arrangement in Oil & Gas projects internationally. Also known as EPCC (Engineering, Procurement, Construction, Commissioning), LSTK (Lump sum Turnkey) and EPIC (Engineering, Procurement, Installation and Commissioning), they are all variations of a common base which is covered by the FIDIC Silver Book.

The course focus is on the FIDIC Silver Book and it use to author and manage best practice EPC contracts within OGE project environments. An emphasis is placed upon both client organisations and contractors’ perspectives; as well as on a pragmatic commercial, business and project issues, challenges and approaches.

EPCM CONTRACTS FOR OIL & GAS PROJECTS
EPCM (Engineering, Procurement and Construction Management) Contracts differ from EPC contracts in a critical strategic manner, in that ECPM contracts introduce a third party – the Construction Manager – who enters into an agreement with the client (EPCM Contract) to design, procure and then manage the construction of the project. Critically, this involves using different contract forms with individual contractors to do the actual work.

ECPM contracts are increasingly becoming more popular with client organisations who wish to have a professional manager working on their behalf and standing between them and the contractors carrying out the actual work.

The course focus is on providing a professional understanding of and approaches to the authoring and management of ECPM contracts; a professional understanding of and approaches to different commercial contract types; the use of judicious contract selection and authoring to reduce  strategic and operational project risk management tools within a wider toolkit of Risk Management techniques. There is an emphasis upon pragmatic commercial, contract and project management.

TROUBLESHOOTING OIL AND GAS PROCESSING FACILITIES

This technical webinar course will provide knowledge, understanding and application of problem solving and troubleshooting tools and techniques that are used in oil and gas facilities.
